This page answers the questions people ask most about ESA, and corrects the myths that cause the most harm. Each answer states the rule first and the reasoning second, so you can act on it without reading the whole site again.

Can I claim ESA if I have savings?

Yes, for New Style ESA. Savings do not affect a New Style ESA claim, and neither does your partner's income. That is the single most common reason people fail to claim when they qualify. The means test people are thinking of belongs to Universal Credit and to income-related ESA, not to New Style ESA.

Can I claim ESA if I am still employed?

Yes. You can apply whether you are employed, self-employed or unemployed. If you are on Statutory Sick Pay, you cannot receive ESA at the same time, but you can apply up to 3 months before SSP ends so that ESA starts immediately afterwards.

Do I need a diagnosis to claim ESA?

No. ESA is not awarded for a diagnosis; it is awarded for limited capability for work. The assessment measures what you can and cannot do, and how your condition affects you day by day. Two people with the same diagnosis can receive different outcomes, and two people with different diagnoses can receive the same outcome, because the test is functional, not diagnostic.

Will working a few hours end my ESA?

Not if the work is permitted work: less than 16 hours a week and no more than £203.50 a week after tax and National Insurance, agreed with Jobcentre Plus in advance on the PW1 form. Supported permitted work has no hours limit but the same earnings cap. Voluntary work has no hours limit. Work outside those limits can end ESA, so agreement first is essential.

Does ESA stop at State Pension age?

You cannot usually receive ESA once you reach State Pension age. At that point, State Pension becomes the main benefit, and Pension Credit may help if your income is low. If your partner is under State Pension age, a couple's claim position may differ, so check before assuming everything stops on the same date.

How long does ESA last?

In the support group, there is no time limit. In the work-related activity group, New Style and contribution-based ESA last for 365 days. Income-related ESA has no time limit while you remain eligible. If your 365 days are ending, check Universal Credit and the reapplying rules early.

Can I get ESA and PIP at the same time?

Yes, and PIP does not reduce ESA. They are separate benefits with separate assessments. Claiming PIP does not harm an ESA claim, and an ESA award does not harm a PIP claim.

Myth: "ESA is just for people who can never work again."

False. The work-related activity group exists precisely for people who cannot work now but may be able to prepare for work in the future. ESA supports that preparation through work coach interviews and permitted work, rather than writing people off.

Myth: "If I am refused once, I can never claim again."

False. You can challenge a refusal through mandatory reconsideration and tribunal appeal, and you can make a fresh claim later, particularly if your health has changed or your National Insurance record has improved. A refusal is a decision on one claim at one time, not a permanent bar.

Myth: "The DWP will know if my circumstances change, so I do not need to tell them."

False, and dangerous. The DWP relies on you to report changes, and an unreported change can create an overpayment that must be repaid. Report promptly, keep a note of the report, and do not assume another agency or employer has told the DWP for you.

Still unsure? Work through the site in order: who can claim, the two groups, the assessment, rates and payments, how to claim. If you are still unsure after that, Citizens Advice and local welfare rights services give free, confidential help with ESA claims and challenges, and a benefits calculator can show the full picture across ESA, Universal Credit and PIP together.
